The Way the System Works

The Louisiana workers' compensation system is designed to return an injured person to work as quickly as possible. Once the injured person is released from medical care, he or she is expected to return to employment even if they cannot return to their same position or, even with the same employer, and workers' comp benefits may cease.

To provide some financial compensation during the victim's time of recovery, the individual may receive a percentage of his or her wages as long as the doctor recommends the person to refrain from work. Pain and suffering damages are separate from workers' comp. These damages may be connected to the workers' comp system if a person is injured by a third party while on the job. This is known as a third party claim for damages.
